What are the penalties for drug possession?
The penalties for drug possession will depend on the quantity of drugs and whether they are class A, B or C.
The penalty for possession of Class A drugs is up to 7 years in prison, an unlimited fine or both.
The penalty for possession of Class B drugs is up to 5 years in prison, an unlimited fine or both.
The penalty for possession of Class C drugs is up to 2 years in prison, an unlimited fine or both. The only exception to this is for anabolic steroids, where it is not an offence to possess them for personal use, but supply and production remains an offence.
How long do you get for Class A drugs?
This will depend entirely on the level of culpability the defendant is found to have the harm caused or that could potentially have been caused by the drugs in question (usually determined by the quantity of drugs involved).
The standard sentencing range for a Class A drugs offence is 3.5-16 years.
