MPR instrumental in City professional avoiding being charged with criminal offences

MPR solicitors Private Client Team were retained to provide pre-charge advice to a City professional who was originally arrested for allegations of cyberstalking and controlling and coercive behaviour on an ex-partner.

We were instructed by our client after he was interviewed by police without the benefit of a solicitor. Unfortunately, this often happens when individuals who have never had any experience of the Criminal Justice System other than perhaps a minor motoring offence, are arrested or invited for a “chat” by officers and believe they have “nothing to hide”. We always advise our clients to seek specialist criminal defence legal advice especially if you work in a sector where a caution or a conviction could end your career or bar you from working in a particular role.

We immediately arranged for an initial consultation remotely due to Covid-related restrictions and devised a road map with the client on the strategy to adopt going forwards.

We agreed a plan of action and a budget for legal costs.

We prepared the case, interviewed various witnesses, prepared a defence dossier, obtained counsel’s independent legal opinion to bolster our submissions and took part in pre-charge engagement with the police.

As a result of our written submissions and engagement with the police at an early stage, we were able to persuade them not to prosecute the case but instead to issue the client with a harassment warning which is not a caution or a criminal conviction and would not be disclosable in a DBS check.
