Company director escapes jail for gross negligence manslaughter in HSE prosecution

  • Posted

In a prosecution bought by the Health and Safety Executive MPR were acting on behalf of a company director who faced charges including gross negligence manslaughter arising from a tragic accident in a factory in North London which left an employee dead. Health and Safety charges included Failing to discharge a duty under section (1) of the Health and Safety at Work Act 1974 and conniving and consenting to discharge a duty under section 37(1) of the Health and Safety at Work Act 1974.

Through our dedicated work and preparation of the case our client escaped the almost certain custodial sentence and was sentenced to a suspended sentence order.

At MPR solicitors our Business Crime team are highly experienced in all aspects of Health and Safety legislation and defending companies and directors facing charges under the Health and Safety at Work Act 1974.
