Motorist four times over drink drive limit avoids prison

We were instructed to represent a young motorist who was charged with Driving whilst above the prescribed alcohol limit. In this particular case, he was 4 times over the legal limit, had collided with a stationary vehicle and was facing an immediate custodial sentence. The client and his family got in touch with us as they wanted expert Motoring Law advice and a Partner-led strategy rather than turn up to Court unprepared and be represented by the Court Duty Solicitor which is a free service for those defendants who cannot afford legal representation or have not been able to secure any representation in time for their case.

 

With careful and skillful guidance and a sympathetic understanding of the client’s personal situation, we were able to prepare his mitigation fully and use our expert knowledge of Motoring Law and criminal law procedure to secure a non-prison sentence for him.

 

We structured a full mitigation strategy led by a Partner, a tight timeframe within which to compile all the relevant evidence and take statements from character witnesses, liaise with the Crown Prosecution Service in time to obtain the case file ahead of the hearing, attend upon the client and his family as many times as they felt it necessary and tailor the right level of lawyer to their needs and budget.

 

Our lawyer then made detailed and skilful oral representations at the court hearing and was also able to convince the magistrates not to adjourn the case for sentencing (which would have caused further anxiety to the client and his family and additional legal costs) and to deal with the whole case at the first appearance in court.
