Drugs Acquittal at Lewes Crown Court

drug importationMPR Solicitors secured the only acquittal in a large-scale drugs conspiracy case which was heard at Lewes Crown Court. The case originally involved 18 defendants charged with conspiracy to supply millions of pounds of class A drugs, importation and money laundering offences. The investigation spanned months of police surveillance, covert audio probes in vehicles and voice recognition evidence. Our client faced many months on remand awaiting his trial but when the time came we were able to successfully challenge and discredit the forensic evidence in the case which was presented by the prosecution. Our client walked free from court upon his acquittal. The defence team in this case was led by Abdullah Al-Yunusi, a senior barrister at the Firm who regularly defends in high-profile cases across the country. He was assisted by a Partner from the Firm’s Serious and Complex Crime team.

Client cleared from SOCA money laundering investigation

He had come under SOCA’s radar as a result of covert surveillance from London to the Midlands involving cash drops of several hundred thousand pounds at a time.

He was interviewed at length over 2 days whilst in police custody and we advised him throughout the police investigation. It was a very stressful time for both him and his family and we kept all relevant sides informed and updated until we secured his release without charge.

Acquittal secured by MPR barrister in “honour” kidnap and torture case

solicitor defence kidnap londonWe were instructed to represent a Defendant charged with kidnap, indecent assault, blackmail, s18 GBH (Grievous Bodily Harm) and false imprisonment in a trial which lasted over 8 weeks. Our client was one of 6 defendants in the trial, all charged with similar offences.

The case involved an “honour” kidnap and torture of a young Bengali male who was held captive for several days in a flat in the Bow area of East London. It is alleged that the victim was repeatedly beaten, set fire to and sexually assaulted during his days of captivity at our client’s flat. A ransom was demanded from the victim’s family to secure a release.

The Metropolitan Police Service’s specialist Kidnap Squad were called in and 40 officers, some armed with machine guns forced entry into our client’s flat using explosives.

The case involved complex legal issues and argument together with forensic evidence.

Our barrister made very forceful half time submissions of no case to answer in relation to the charges and the trial judge agreed with our advocate’s legal arguments and dismissed the following charges against our client: kidnap, blackmail, indecent assault, s18 GBH.

The defendant was represented at his trial by Abdullah Al-Yunusi who is a senior barrister and heads the MPR advocacy team at the Firm. Abdullah is also a member of a leading criminal barristers chambers listed in the Legal 500.

Acquittal secured by MPR in conspiracy to commit armed robberies at Kingston Crown Court

Today, we secured a unanimous not guilty verdict at Kingston Crown Court for our client who stood trial for several conspiracies to commit armed robberies across London and the South East. The trial was part of a series of trials involving 22 defendants all charged with conspiracy to commit armed robberies. The case had to be split into 3 separate trials for case manageability purposes. Our client’s trial lasted 5 weeks.

This was a SOCA prosecution codenamed “Operation Staten” and involved thousands of pages of prosecution material including forensic, cell site, mobile phone downloads, phone analysis, CCTV and surveillance.

Our client is alleged to have been the getaway driver in a number of the armed robberies which targeted mobile phone shops across London and the South East using inside information.

We were able to run a pro-active defence for our client and challenged all relevant parts of the Prosecution case. Our expertise in dealing with complex cases of this nature involving large amounts of paperwork and complex forensic evidence enabled us to secure our client’s acquittal. The case was properly and fully prepared and no stone was left unturned. The trial advocacy was conducted by a senior member of the in-house MPR advocacy team. By keeping the advocacy in-house, we were able to provide our client with a seamless service headed by a senior in-house barrister with whom they were able to be in constant contact over the 12 months that it took for the case to conclude.

MPR success in conspiracy to defraud case

tax fraud solicitors londonThe client was charged with conspiracy to defraud a local authority in the 1980s in connection with housing building grants. After the Crown Prosecution Service delayed in the service of outstanding case papers, we decided to instruct our own expert and also mount an abuse of process argument against the Crown and their prosecution of the case. Written representations were made and skeleton arguments served upon the Crown’s lawyers. At the eleventh hour, the Crown decided to drop the case against our client and offered no evidence.

As this was a privately funded case, we were also able to apply for a defence costs order in the case which means that our client may get back all of his legal costs incurred in defending the case from Central Funds. This will amount to several thousands of pounds. An extremely good result and a very happy client.

MPR secures only acquittal in students riots case

On 5 October 2011, a 16 year old schoolboy walked free from a central London Criminal Court after being found not guilty of one charge of violent disorder. This is the first and only student riot case which has resulted in an acquittal before the courts and is a testimony to the way in which our clients’ cases are prepared: uncompromising in our standards.

On 9 December 2010, our client who was then only 15 years old, attended the student demonstrations in London in Parliament Square to exercise his democratic right to protest against the government’s proposals on university tuition fees. It was alleged that our client smashed a window to the Treasury Building and assaulted a high ranking police officer (Inspector) by kicking him in the head during the riots. Our client had always protested his innocence since the day he was arrested by police.

The defence case was that the Inspector was mistaken in the identity of his attacker and the person who is alleged to have smashed the Treasury Building window. In fact our client was acting as peacemaker between the students and the police as he was so shocked by what was happening by some unruly elements at the scene.

We recognised that the case would involve a very pro-active defence and the team at MPR set about devising a case strategy. We asked our client to assist us in trawling through hours of video and CCTV footage on the internet of the student riots in case there was any footage in the public domain that could assist in corroborating our client’s version of events. We were able to locate and obtain some footage from ITN which placed our client at the Treasury Building at the relevant time but actually showed our client trying to push back angry student protesters away from the battle lines of the police officers on duty in attack mode. Whilst this did not prove or disprove our client’s involvement in smashing a window or assaulting a police officer, it did go towards our client’s credibility when he would give evidence at his trial. The ITN clip was played to the court at his trial.

Our next hurdle was to discredit the evidence of the Inspector and his colleague who was the arresting officer. We analysed their witness statements and made our own enquiries and were able to discredit their evidence at the trial. There were also a number of legal points that arose during the trial over the admissibility over certain pieces of evidence which were decided in our client’s favour.

We traced and obtained witness statements from defence witnesses and called them to give live evidence at trial. We also advised our client to call character references at his trial.

We were very pleased with the outcome of this case and so were our client and his family. It meant our client would not have a criminal record and was free to pursue a legal career or even emigrate to New Zealand which he was planning to do in the next few years.

This is a contrast to the advice given to our client’s school friend who had also been charged with violent disorder at the same time but was not represented by MPR. He was advised to admit guilt in order to accept a caution and a speedy conclusion to his case. He now regrets this course of action as the caution will show up on any CRB check in the future.
