The client was charged with conspiracy to defraud a local authority in the 1980s in connection with housing building grants. After the Crown Prosecution Service delayed in the service of outstanding case papers, we decided to instruct our own expert and also mount an abuse of process argument against the Crown and their prosecution of the case. Written representations were made and skeleton arguments served upon the Crown’s lawyers. At the eleventh hour, the Crown decided to drop the case against our client and offered no evidence.
As this was a privately funded case, we were also able to apply for a defence costs order in the case which means that our client may get back all of his legal costs incurred in defending the case from Central Funds. This will amount to several thousands of pounds. An extremely good result and a very happy client.
